Plan With regards to the above application, I regret I able unable to support as submitted due to the significant breach of the 45 Degree Code in relation to the single storey ground floor extension element and the ground floor rear facing habitable room window of No. 21 The Paddock resulting in loss of light and outlook to the rear of this property. Although, there is an existing conservatory, which is to be removed this only measures a depth of 3.8m and is located 0.6m off the common boundary between the application site and No. 21. In addition, this existing conservatory being over 3m in depth would have also required planning permission, which having done a history search on the property it does not appear to have and this too breaches the 45 Degree Code. The proposed replacement single storey rear extension measures a depth of 4.8m and is located on the common boundary between the two properties – A significant breach of the 45 Degree is also demonstrated on the proposed plans. I would recommend that amended plans are submitted so the single storey rear extension is reduced to a depth of 3m – although this would still breach the 45 Degree Code, this would be overlooked as the single storey rear extension at a depth of 3m could be built under permitted development.
